Main Article Content
Abstract
Under Law No. 15-20 of December 30, 2015, the legislator made several amendments regarding the establishment of the limited liability company [LLC], related to the abolition of the legal minimum of its capital and the freedom to limit it to the partners in the Basic Company Law, without abandoning it as an essential condition for the validity of its formation. This freedom of determination will affect the creditors of the company, especially in the event that the capital of the determinant is of weak value, as well as on the partners and the director.
