Abstract
The phenomenon of illegal immigration by sea, Is of great concern to the international community because of its grave consequences in terms of loss of human life, This situation prompted the international community to recall the legal instruments that provide protection to illegal migrants by sea through various branches of public international law, And to emphasize the need for States to respect the rights of this category regardless of their status, by determining the legal jurisdiction of States in this area, And to highlight the rights enjoyed by such persons, such as the right to life, which is met by the duty of maritime rescue, the right of non-refoulement, and the rights relating to detention.
