Abstract

Following the establishment of the Security Council of Special Criminal Tribunals under Chapter VII, the international community began to think about establishing an international criminal justice system that would deal with serious violations of human rights and international humanitarian law. far from political considerations, but the drafters of The Charter of the International Criminal Court found themselves at the mercy of the Security Council in giving the the referral power and postpone the investigation, which raises the question of the politicization of the demands of justice. What is strange is that the United States of America seeks to impose very harmful efforts to protect American soldiers from court control or the so-called "Hague Invasion law “, and it did not stop there, because the United States does not intend to activate the crime of aggression, which makes the International Criminal Court acquiesce in the policies of the superpowers under the pretext to protect human rights and establish democracy, and the best evidence of the Court's targeting of African leaders, in addition to politicizing the issue of cooperation with the International Criminal Court.
