Authorities of the Social Judge in Resolving Disputes Arising from the Termination of Employment Relations

Abstract
The termination of employment is a pivotal aspect of labor disputes, arising from disciplinary actions due to an employee's serious misconduct or economic measures such as downsizing. This process involves both procedural and substantive controls designed to ensure fairness and legality. Procedurally, employers must follow specific steps, including providing notice and conducting hearings, to justify the termination. Substantively, the reasons for termination, whether due to misconduct or economic necessity, must be well-founded and legally valid.
Legislative oversight plays a critical role in this process through judicial review, where social judges assess the legality and fairness of termination decisions. This oversight ensures that terminations are not only compliant with labor laws but also equitable. If a termination is deemed unjust, a social judge can annul the decision and reinstate the employee, aiming to preserve job continuity and rectify wrongful dismissals.
Additionally, affected employees may be entitled to financial compensation, which serves to mitigate the economic impact of losing employment. This compensation reflects the severity of the wrongful termination and provides some relief to employees who have been unfairly dismissed.
In summary, the termination of employment is regulated by both procedural and substantive controls, with judicial oversight ensuring adherence to legal standards and fairness. The role of social judges in reviewing termination decisions and the provision of financial compensations underscore the commitment to balancing organizational needs with the protection of employee rights.
