Abstract

 



Under the constitutional amendment of 2020, Algeria made a significant transition from political to judicial oversight of the constitutionality of laws by establishing a Constitutional Court. This development replaced the previous system where the Constitutional Council held political oversight. The new Constitutional Court was granted comprehensive powers and responsibilities, notably including the adjudication of appeals related to legislative elections.


The amendment introduced a structured framework for this judicial review process. It specifically allows the Constitutional Court to address issues concerning provisional election results and the final declaration of results. This role involves meticulously following formal procedures as outlined in the operational rules governing the court's activities. Such procedures are designed to ensure transparency and fairness in the electoral process, reinforcing the legitimacy of the election results.


As a result of these changes, the Constitutional Court has assumed a crucial role in overseeing and resolving disputes arising from legislative elections. This new role emphasizes the court's function as an impartial arbiter in matters of electoral integrity. The shift towards judicial oversight signifies a broader commitment to upholding democratic principles and ensuring that legislative elections are conducted in accordance with constitutional norms.


By entrusting the Constitutional Court with these responsibilities, Algeria aims to enhance the credibility and effectiveness of its electoral system. The court's involvement in resolving election-related disputes underscores its importance in maintaining the rule of law and reinforcing the democratic framework within the country. This judicial oversight mechanism represents a critical step in Algeria's ongoing efforts to strengthen its democratic institutions and ensure a fair electoral process.
