Abstract

The question of the maintenance of international peace and security is one of the main functions and responsibilities of the UN Security Council, since the decisions taken at its level affect the rules of international law, such as those relating to peacekeeping operations, special tribunals and international sanctions, with reference to the binding nature of decisions taken under Chapter VII of the United Nations Charter. Under article 13/b of the Rome Statute, the Security Council may refer certain cases to the Prosecutor of the International Criminal Court, so that the latter may exercise its jurisdiction to prosecute the perpetrators of international crimes, namely: genocide; crimes against humanity; war crimes and crimes of aggression.
