Some Observations on the Translation of Civil Law بعض الملاحظات حول ترجمة القانون المدني

Abstract

In this paper entitled "Some observations on the translation of civil law", I intend to show the contradictions between Arabic and French texts of civil law due to disagreement between the opinions of jurists on whether the arabic text or the french text should be the source in the translating task. In order to answer this question, I will first address the contradiction between the Arabic text and the French text in civil law, and then I will address the controversy over the origin of the translated text.
In fact, our law is a mixture of the texts of Egyptian law and French law, in addition to the fact that it contains texts of its own that we do not find either in Egyptian law or in French law. Accordingly, through this research we request the legislator to reconsider the translation of the Civil Code.
